SMU Suspends Fraternity for 2 Years

Southern Methodist University has suspended a fraternity for violating the school's code of conduct.

Overnight Monday, the university suspended Sigma Phi Epsilon for two years.

The school did not say why the fraternity was suspended, but last month four members of the fraternity were suspended after being accused of beating and kicking a freshman before spraying cleaning fluid on his injuries.

The school released the following statment Tuesday:

As of March 25, 2013, SMU has suspended for two years the Texas Upsilon Chapter of the Sigma Phi Epsilon Fraternity because of violations of the SMU Student Code of Conduct and University policies, as well as the standards and values of the fraternity itself. SMU expects its students to uphold high standards of personal and academic integrity. The University believes it is important to take this action and expects the young men of the fraternity to learn from this experience.

Dallas Police Chief Faces Rising Crime Rate

Dallas Police Chief David Brown is facing a problem that has not confronted him in recent years -- a rising crime rate.

For the past nine years, one way or another, Dallas police have almost always posted lower crime figures after the city added hundreds of additional officers to the force.

As of March 20, Dallas police recorded an overall 1.4 percent increase in crime but a 5.9 percent increase in violent crime, led by a 57.9 percent increase in homicides, compared with the same time last year,

Brown told the Dallas City Council Public Safety Committee on Monday that the homicide rate in February 2012 was remarkably low and very hard to beat again.

Brown warned the council members that reducing crime for a 10th straight year would not be easy.

"There will be many ebbs and flows this year with crime," he said. "At the end of the year, I'm confident that we will have another reduction, but it will take officers doing -- as they have done in the past -- a very phenomenal job."

Dallas police have already formed special task forces of officers to fight domestic violence and focus on habitual criminals.

Brown said he is forming another task force to focus on drug houses.

Brown said drug-related homicides are a greater Dallas problem because of past success police have had in arresting drug dealers.

"It's an unintended consequence, but as you shut down mid-level and upper-level drug dealers, there's competition that's created at the street level, and that competition results in drug murders," he said.

The 50-officer unit is training now and should be working by early summer when drug dealers are busiest.

3 Teens Charged in Arlington Truck Driver's Death

Three 17-year-olds were charged Monday in the shooting death of a truck driver from Arlington who was delivering ingredients to a Papa John's restaurant in Oklahoma.

Robert Horton, 53, had worked for Papa John's as a truck driver for UPS for about eight years, his family said. UPS contracts with Papa John's.

Horton was delivering dough and other items to a restaurant in Tulsa on Saturday morning when police say he was shot twice in the chest.

"We just love my dad so much," said his daughter Angela Mansfield. "He was a good person, and he loved everybody."

The apparent motive was robbery, even though the suspects didn't get a penny, police said.

Damian Anderson, Jermaine Savory and Frankie Jackson, all 17, face first-degree murder charges. They are suspected of other recent robberies, police said.

Anderson's mother told NBC station KJRH-TV in Tulsa on Monday that her son, a high school junior, was arrested as he left for the bus stop Monday morning.

"I don't care what they say, my baby didn't do this," Lashon Anderson said.

Mansfield said she and her family have strong faith and hold no grudges against the young suspects.

"I just can't come to be angry," she said. "I am not angry."

But she said she does wonder why.

"I don't know what they were thinking, why they did it, what their motive was," she said. "I know that God allowed it to happen for whatever reason. But I will never understand that reason."

Horton served in the U.S. Army when he was younger, and his family said he worked hard to give them a good life.

"He is a good man, a very good man," Mansfield said. "I mean, there are no words that can describe my father. He was quirky. He was sweet-spirited."

Horton was married to his wife, Lisa, for 30 years and had two children and six grandchildren.

"I do miss him," his daughter said. "I just -- I want to see him so bad."

Police Warn of Facebook Child Porn Virus Video

Some Congress members are asking Facebook to take down pages that appear to be in tribute to victims of the shooting at Sandy Hook Elementary School.

Police have issued a warning about a computer virus linked to a pornographic video on Facebook.

The FBI is getting involved in the investigation and several school districts in Connecticut have issued alerts to students and parents to warn them about the virus.

"I'm very concerned that something like this would be circulating," said Farmington School District Supt. Kathleen Greider.  

According to Simsbury Police Department in Connecticut, the video is shared through Facebook and appears to be from a friend, though it is actually child pornography. 

Several Farmington High School students have received the video on their Facebook accounts, police said.

Once opened, the video virus automatically attaches to the user's Facebook account and shares the video with all of his or her Facebook friends.

NBC Connecticut viewers who have received the video say it doesn't appear to be child pornography before opening and contains the phrase "watch this if you're curious."

New Britain police and the New Britain school district posted warnings on their Facebook pages. According to New Britain police, authorities in Farmington, Cromwell and Hartford have contacted the FBI about the video.

Avon schools also sent an email to parents and staff members about the Facebook virus threat.

"Although your child may not attend FHS (Farmington High School), other students or siblings in the area may have Facebook accounts that could be affected and we wanted to alert you of this situation immediately,"  Gary Mala, Avon superintendent, said in the email.  "The video is quite graphic and it will be very disturbing."

Greider emailed every parent and at least three other districts sent out alerts as well.

"We wanted to get a communication out to them immediately," Greider said.

Facebook has released a statement, saying it has a zero tolerance for child pornography and is aggressively trying to remove it.

The Federal Bureau of Investigation is trying to determine how the images got onto the Internet.

Former Trooper Indicted in Roadside Cavity Search

The female Texas trooper who performed a roadside cavity search on two Irving women has been indicted by a Dallas County grand jury.

The two women from Irving are suing Trooper David Farrell, Trooper Kelley Helleson and the director of the Department of Public Safety for what they call an unconstitutional search without probable cause.

The Department of Public Safety terminated Trooper Kelly Helleson. Dallas County District Attorney spokeswoman Debbie Denmon confirmed on Monday that a grand jury indicted Helleson on two counts of sexual assault and two counts of official oppression.

NBC 5 contacted Helleson's attorney for comment. "The charged against my client are untrue," said Bob Baskett. Helleson is currently appealing her DPS termination.

Denmon said Farrell was indicted on a theft charge. The DPS put Farrell on paid suspension after the incident.

July Incident Makes National Headlines

On July 13, while driving along State Highway 161, Angel Dobbs and her niece Ashley Dobbs were stopped for littering by Farrell. In the dashcam video released by the women and their attorney, Farrell can be heard telling the women they would both be cited for littering for throwing cigarette butts out of the car.

Farrell then returned to his cruiser and, in the video, can be heard calling female Trooper Helleson to the scene to search both women whom he said were acting weird.

While waiting for Helleson to arrive, Farrell asked Angel Dobbs to step out of the vehicle and began questioning her about marijuana use. In the video, the trooper is heard telling Dobbs he smelled marijuana coming from the vehicle while asking her several times how much pot was in the car.

After Helleson arrived, she can be seen in the dashcam video putting on blue latex gloves to conduct a search of both women. According to the lawsuit, when Angel Dobbs asked about the gloves, Helleson "told her not to worry about that."

In the lawsuit, Dobbs said the trooper conducted the cavity search on the roadside, illuminated by the police car's headlights, in full view of any passing motorists.

"This has been an eye-opening experience for me. I've never been pulled over, never searched like this. I was totally violated over there a few minutes ago... this is so embarrassing to me," Angel Dobbs said on the video.

"I've never been so humiliated or so violated or felt so molested in my entire life," Angel Dobbs told NBC 5.

Dobbs said she never gave consent for the trooper to "frisk, pat-down, search or otherwise touch her" and that she never gave consent for Farrell to search her vehicle -- which he can be seen doing in the dashcam video while the cavity search was under way.

Dobbs said she was powerless to stop it. "What are you going to say? What's going to happen to you if you challenge that authority?" she said.

With the cavity search concluded, Farrell then asked Dobbs about prescription medications found in the car.  Dobbs said they were for her thyroid and for migraines. According to the lawsuit, Dobbs also suffers from a medical condition that was irritated by the search.

Meanwhile, Helleson can then be seen performing the same cavity search on Dobbs' niece, Ashley.

"It's because somebody is a daily smoker in that car. OK, you can attribute it to that," Farrell can be heard saying on the recording.

The lawsuit further alleges that Helleson performed searches on both women, touching both their anus and vaginas, without changing the latex gloves between searches.

"I don't think anybody needs to have to feel, or go through what we went through," Ashley Dobbs said. "It crosses my mind every day. It's humiliating," she said.

After searching the entire car and finding no narcotics, Farrell then administered a DWI test that Dobbs passed, the lawsuit said. The women were then issued warnings for littering and released at the scene.

The lawsuit goes on to say that a bottle of prescribed hydrocodone was missing from Dobbs' car and purse after the search. The women returned to the scene of the traffic stop the next day to search for the medication, but it was nowhere to be found.

Their lawyers say the search was illegal and a complaint about it was filed in August but that DPS Texas Rangers who investigated the incident took no action.

"This is outside the constitutional grounds by a mile. It's not even close," attorney Scott Palmer said. "This has to stop. These two need to be stopped. There's no telling how many other people they've done this to and we hope that others come forward."

Attorney Charles Soechting Jr. said his father was a DPS trooper and he has great respect for the agency. "But in this instance they have completely failed the citizens of Texas," Soechting said.

Soechting said a records request to DPS produced no policy that allows for cavity  search of any suspect in public.

"What we're dealing with is a Class C misdemeanor. It does not justify any type of pat-down, let alone an invasive search of cavities of women,"" he said.

DPS has not commented on the case.

The women are requesting a trial by jury and are asking for unspecified, compensatory and exemplary damages and interest as well as recovery of attorney's fees and court costs.

Sharktopus and Dinoshark may be the products of Hollywood, but a two-headed bull shark found in the Gulf of Mexico is all too real, according to scientists with Florida Keys Community College and Michigan State Community College.

The scientists have confirmed that the shark, discovered in April 2011, is the first of its kind and is a single shark with two heads and not conjoined twins.

"This is certainly one of those interesting and rarely detected phenomena," MSU assistant professor of fisheries and wildlife Michael Wagner said in a statement from the school Monday. "It's good that we have this documented as part of the world's natural history, but we'd certainly have to find many more before we could draw any conclusions about what caused this."

Migrating Sharks Seen Again Off Deerfield Beach

The shark was found by a fisherman when he opened the uterus of an adult shark. It died shortly thereafter and was brought to the marine science department at FKCC, where it was then transported to Michigan State.

Wagner and his team discovered two distinct heads, hearts and stomachs, with the rest of the body joining together in the back to form a single tail.

Creatures found with abnormalities like this usually die shortly after birth, and the two-headed bull shark had little, if any, chance to survive in the wild, Wagner said.

Other species, including blue sharks and tope sharks, have been born with two heads, as well as lizards and snakes, Wagner said.

DART Cracks Down Drivers Skipping Pay to Park

Dallas Area Rapid Transit could soon expand its Pay to Park program to crack down on drivers finding ways around the fee.

Currently, Plano's Parker Road and Northwest Plano stations charge $2 per day for people outside the 13-member service area, who don't pay taxes to DART, to park at the station. 

Nearly half of those riders have been driving to nearby stations and parking for free, DART said.

Now, DART will consider changing the Trinity Mills and George Bush stations to Pay to Park locations to discourage drivers from doing that.

The planning committee will meet at 1:30 p.m. Tuesday.

After much ado and a very long wait, Dallas-Fort Worth International Airport and American Airlines are unveiling renovations to Terminal A and the attached Terminal A parking facility.

The renovations are a joint effort between both the airport and the Fort Worth-based airline and include improvements to not only the terminal, but the parking structure as well. 

The overall goal is to enhance the customer experience and includes updated facilities for parking, ticketing, security and concessions.

The terminal and parking improvements are key components of the Terminal Renewal and Improvement Program, which is a seven year, $2.3 billion program to renew DFW's four original terminals which were built in 1974 when the airport opened.

Eventually, all of the other terminals will get the same extreme makeover as Terminal A. 

The new parking structure includes new technologies to easily guide drivers to available spaces through the installation of lights above each parking spot that change from green to red to indicate whether the spot is available.  Blue lights indicate spaces available for handicapped drivers.

"We believe this new parking facility will be an instant hit with passengers while giving us much needed new capacity to accommodate our parking customers," said Jeff Fegan, CEO of DFW Airport, in a statement released to the media Tuesday. "The structure will have great improvements, while solving the age-old problem of finding a space quickly and easily."

The airport said that, when complete, the new parking structure will add 7,793 parking spaces to the airport -- bringing the total number available to 42,000.  The structure also includes enhanced terminal entries with covered walkways, better lighting, higher clearances, improved ADA compliance, improved traffic flow and a pedestrian bridge from infield parking to the parking structure.

Additionally, those who use the airport's smartphone app can access up-to-the-minute information on space availability.  

In the terminal, American Airlines is also unveiling its prototype for future airport terminals that incorporates the airline's fresh new look with technology designed to improve the traveling experience.

Work to Terminal A will be completed in 2014, while work to all four terminals are scheduled to be completed by 2017.

The Fort Worth City Council will vote on a new police contract that will prevent cuts to the department Tuesday morning.

The Fort Worth City Council voted to approve a new police contract Tuesday morning that will prevent cuts to the department.

The new contract with the Fort Worth Police Officer's Association will last four years, through the 2016 fiscal year, and cost Fort Worth $34.5 million.

Over the course of the contract, all police officers would get a 6 percent pay increase, in addition to any step raises the officer may receive.

There are more than 1,500 police officers in Fort Worth. More than 80 percent of them have voted in favor of the contract.

The discussion Tuesday morning was expected to be heated, because city leaders will have to reconcile their desire to avoid police cuts with the fact that Fort Worth faces a $50 million budget shortfall next year.

The owner of an Arizona gun store canceled Mark Kelly's purchase of an AR-15 semiautomatic rifle after Kelly made comments to the media that he purchased the gun to demonstrate how easy it is to obtain a firearm.

Douglas MacKinlay, owner of Diamondback Police Supply Co. in Tuscon said a full refund was sent to Kelly last Thursday.

"While I support and respect Mark Kelly's 2nd Amendment rights to purchase, possess, and use firearms in a safe and responsible manner, his recent statements to the media made it clear that his intent in purchasing the Sig Sauer M400 5.56mm rifle from us was for reasons other then for his personal use," MacKinlay said in a statement on their Facebook page obtained by NBC News.

Kelly, husband of former Rep. Gabrielle Giffords, is a gun control advocate who recently said in an interview that he wanted to demonstrate how easy it is to purchase a gun. Kelly and Giffords, who was injured in a mass shooting in Tuscon have been lobbying for background checks and restrictions on the sale of high-capacity magazines.

"It's important for me to have firsthand knowledge about how easy it is or difficult it is, you know, to buy a weapon like that," he told CNN's Wolf Blitzer in an interview earlier this month.

MacKinlay said the rifle will be donated the Arizona Tactical Officers Association and raffled off to raise funds for the organization's equipment needs.

Kelly made news on Monday when he stepped in to pull a dog off of a sea lion that it attacked it killed on a beach in California. The dog belonged to Kelly's daughter.
